These constitute a partial list of the ordinances, all of which will be strictly enforced. Your cooperation in obeying these ordinances will result in a community of which you can be proud.

ORDIANCE NO. 7 – BRUSH, GRASS WEEDS – Prohibits weeds or other vegetation in excess of 10 inches. Penalty no more than $300 fine and cost of prosecution.

ORDINANCE NO. 10 – DANGEROUS STRUCTURES – All dangerous buildings and structures declared to be a public nuisance shall be repaired or demolished within 30 days or be subject to a $300 fine and cost of prosecution.

Ordinance No. 18 – CURFEW – It shall be unlawful for any person under eighteen (18) years of age to be or remain in or upon any public streets, alleys or public commons in the Borough at night after the hour of 10 pm.  Penalty $300 fine and cost of prosecution or 30 days in prison.

Ordinance No 22 – FIREARMS – It shall be unlawful to discharge a rifle, air rifle, or air gun of any kind and description which impels with force a pellet of any kind.  Penalty $300 fine and cost of prosecution or 30 days in prison.

Ordinance No. 28 – HEALTH AND SANITATION – Any and every person who creates, continues or maintains a nuisance prejudicial to the public health (including but not limited to waste water, stagnant water, farm animals etc.), shall be deemed guilty of a violation of this Ordinance.  Penalty is no more than $300 fine and cost of prosecution or 30 days in prison.

Ordinance No 35 – LITTERING –  Litter carelessly deposited in the Borough is the cause of civic disgrace, litter is a health, fire and safety hazard, a pollutant, and a matter affecting the public interest.  This includes cigarette butts.  Penalty is not less than $300 fine and cost of prosecution or 30 days in prison.

Ordinance N. 38 – MINIBIKES AND MOTORCYCLES – It shall be unlawful for anyone to operate a motorcycle, minibike or any other type of motor vehicle on the sidewalks, footpaths, parks or property belonging to anyone other than the operator or driver of such motor vehicle, unless said operation upon the property of another is with the written permission of the owner of said property.  Penalty no more than $300 and cost of prosecution or 30 days in prison.

Ordinance No. 48 – PLAYGROUNDS AND RECREATION AREAS – The playground areas owned by the Borough shall have the following regulations: (a) Hours open daily to the public shall be between 8:00 a.m. and 9:00 p.m.  (b) No person shall deface vegetation, buildings and equipment.  (c) No removing or relocating equipment.  (d)  No annoyance of other persons within the playground area.  (e)  Refuse disposal shall be prohibited.  (f) No posting of placards shall be made within the playground area.  (g) No person shall bring alcoholic beverages into the playground area.  No animals permitted.  Penalty no  more than $300 fine and cost of prosecution or 30 days in prison.

Ordinance 556 – SEWERS – No privy vault, cesspool, septic tank of another receptacle for human excrement shall be constructed or maintained upon any property within the Borough of Marion Heights.  Penalty $300 fine and cost of prosecution or 30 days in prison.

Ordinance No. 59 – STREETS AND SIDEWALKS – Article 1 – The owner or owners of lot or lots fronting or abutting upon any street or highway within the Borough shall, after notice, construct curb or curbs and gutters along the front thereof within 30 days from the date of the giving of such notice. 

Article II –  It shall be unlawful for any person to open or to make any excavation of any kind in any street in the Borough without first securing issued by the Building Code Officer employed by the Borough. 

Article III – The owner or occupancy of any premises shall keep the contiguous sidewalks free from snow, ice, filth, dirt, weeds or other obstruction or encumbrances and in good and safe repair and shall cause such sidewalk to be cleared of snow and ice within 24 hours after any snowfall shall have ceased or ice formed.

Article IV – No person, firm or corporation shall cause any earth, stones, bricks, building material or other matter or substance to be collected or remain upon any street of the Borough.  Penalty no more than $300 and cost of prosecution, or 30 days in prison.

Ordinance No. 66 – Abandoned Vehicles – Any motor vehicle which is found unattended without the current year’s registration plate or inspection sticker as required by law, and which has been parked on any public land or private property for a period of 30 days shall be removed form Borough limits.  Penalty $300 fine and cost of prosecution including costs of the Borough removing the abandoned vehicle.

State Dog Law:  Section 702 – It shall be unlawful for the owner or keeper of any dog to fail to always keep such dog either (1) confined within the premises of the owner, or (2) firmly secured by means of a collar and chain or other device so it cannot stray beyond the premises on which it is secured, or (3) under the reasonable control of some person.  Regulation cites that all pet owners must remove or clean up all fecal waste deposited by their dogs on public or private property.  Penalty not more than $300 and cost of prosecution, or thirty (30) days in prison.

It is a violation for Dogs animals and birds to make noise continuously for five minutes, or intermittently for one-half hour or more, that disturbs others any time of the day or night. Fines are double if violation occurs between the hours of 9PM and 7AM.

35-15: Owners to maintain private premises litter free.

59-26: Storage of goods on sidewalks prohibited.
